Fennell is at the centre of a transfer storm that is expected to make him ineligible for inter-county duty in the coming weeks.
The giant midfielder was blocked in his attempts to move from O'Toole's to St Vincent's last Monday, but he is expected to take his case to the DRA as he is unwilling to play for his home club.
Gilroy, meanwhile, has been told by the Dublin County Board that Fennell is eligible for inter-county until such time as he refuses to line out for O'Toole's in a competitive fixture.
"He played against Meath on Wednesday, so why would I not know where I stand? He's playing," Gilroy, the former Vincent's full-forward said.
"If Eamonn is playing well enough he'll play in the National League. How could he play against Meath and not in the National League?
"From our perspective, no one has said anything to me. Whatever happens with his club is a side issue - it has nothing to do with the Dublin team."
Gilroy added: "He's there, he's available to me. I'm playing him. It doesn't seem to be causing him too much problem given his last two performances. You just get on with it. He's there, he's playing well, he's training hard - so that's it."
